REVISED CHINA'S FOOD SAFETY LAW TO TAKE EFFECT
Xinhua News Agency, Beijing, October 31st The State Council Premier Li Keqiang recently signed an order of the State Council to announce the revised Regulations on the Implementation of the Food Safety Law of the People's Republic of China (hereinafter referred to as the "Regulations"), which will take effect on December 1, 2019. The "Regulations" consists of 10 chapters and 86 articles.
The Party Central Committee and the State Council attach great importance to food safety. The implementation of the newly revised Food Safety Law in 2015 has effectively promoted the overall improvement of China's food safety. At the same time, food safety still faces many difficulties and challenges. Some effective practices in regulatory practice also need to be summarized and raised into legal norms. In order to further refine and implement the newly revised Food Safety Law and to resolve problems still existing in practice, it is necessary to amend the Regulations.
The "Regulations" have strengthened food safety supervision, requiring the people's governments at or above the county level to establish a unified and authoritative regulatory system, strengthen supervision capacity building, supplement and stipulate regulatory measures such as random supervision and inspection, remote supervision and inspection, improve the reporting and reward system, and establish serious violations of the law. The blacklist system for producers and operators and the joint disciplinary mechanism for untrustworthiness.
The "Regulations" have improved basic systems such as food safety risk monitoring and food safety standards, strengthened the use of food safety risk monitoring results, standardized the formulation of local standards for food safety, clarified the scope of filing of corporate standards, and effectively improved the scientific nature of food safety. .
The "Regulations" further implemented the food safety main responsibility of production and business operators, refine the responsibilities of the main responsible persons of the enterprise, regulate the storage and transportation of food, prohibit the false propaganda of food, and improve the management system of special foods.
The "Regulations" have improved the legal responsibility for food safety violations, and imposed fines on the legal representative, principal responsible person, directly responsible person in charge and other directly responsible personnel who have deliberately committed illegal acts, and added new Obligatory regulations set strict legal responsibilities accordingly.
